Recreational Access and the HSW Act

The Health and Safety at Work Act of 2015 did nothing to alleviate the problem of land owners and managers denying recreational access due to perceived risk and liabilities. In fact, it may have even made the problem worse.

The closure of the Auckland Grammar Rock Wall ('The Quarry') was a catalyst for NZRA and NZAC to lobby WorkSafe. Rounds of letters, meetings, stakeholder consultations and representations to the Minister have appeared to spark some action.

WorkSafe have committed to developing guidance material for land managers that should provide confidence and reassurance to those that are faced with a choice to allow recreational access. It was indicated that that guidance would be delivered in 2018, so we would expect to see a draft in the coming weeks.

In the meantime, NZRA advises it members to utilise the guidance material provided by the Walking Access Commission.
